CCPA Privacy Notice

Ivy Energy Inc. (the “Company” or “Us” or “We”) prides itself in taking the steps necessary to comply with the California Consumer Privacy Act (the “CCPA”). Accordingly, please review this CCPA-specific privacy notice (the “CCPA Privacy Notice”). This CCPA Privacy Notice applies to individuals residing in California from whom We collect “Personal Information” (as defined by the CCPA) and is meant to supplement the Company’s Privacy Policy (found at CCPAPRIVACYNOTICE) as applicable. Any terms defined in the CCPA have the same meaning when used in this CCPA Privacy Notice.

Collection of Information

To better understand what the categories of Personal Information that We have collected and/or disclosed for a business purpose in the preceding twelve months, please see the following chart. The examples of Personal Information provided for each category are taken from the CCPA and are included to better explain what the categories mean. The examples are not all inclusive and are not meant to indicate all Personal Information that We actually collect or disclose.

Your California Privacy Rights

If you are a California resident, the CCPA affords you the ability to exercise the following rights:

Right to Know and Access

You have the right to submit a verifiable request for information regarding the following information:

• The categories of Personal Information We have collected about you;
• The categories of sources for the Personal Information We have collected about you;
• The business or commercial purpose for collecting or selling such Personal Information;
• The categories of third parties with whom We shared such Personal Information;
• The specific pieces of Personal Information We collected about you (also called a data portability request);
• The business purpose for which Personal Information was disclosed (if in fact the Personal Information was disclosed for a business purpose) and the Personal Information categories that each category of recipient received.

Right to Delete

You have the option to request us to delete Personal Information about you that We have collected from you (subject to certain exceptions).

Verification

Pursuant to all relevant CCPA requirements, limitations, and regulations, requests for access to or deletion of Personal Information are subject to our ability to reasonably verify your identity for the information request you may have submitted.

Right to Equal Service

We will not discriminate against you (such as without limitation denying you any goods or services) for the exercise of your CCPA privacy rights.

Right to Opt-Out of Our Selling Your Personal Information

You have the right to opt-out of our selling your Personal Information. In order to exercise this right, please send a verifiable request email to the following address: info@ivy.energy. Please be sure to include your name and your email address or mailing address in the request.

Shine the Light

We do not rent, sell, or share your Personal Information with nonaffiliated companies for their direct marketing purposes unless We have your permission.

Submission of Requests

Only you or a person registered with the California Secretary of State that you authorize to act on your behalf may make a verifiable consumer request related to your personal information. You may also make a verifiable consumer request on behalf of your minor child.

The Company will endeavor to respond to a verifiable consumer request within forty-five (45) days of its receipt. If we require more time to respond to your verifiable consumer request (up to 90 days), We will inform you of the reason and extension period in writing. We will deliver our written response electronically. Any disclosures We provide will only cover the 12-month period preceding the verifiable consumer request’s receipt as required by the CCPA. If applicable, our response will also explain the reasons We cannot comply with a request. For data portability requests, We will select a format to provide your personal information that is readily useable and should allow you to transmit the information from one entity to another entity without hindrance.

We will not charge a fee to process or respond to your verifiable consumer request unless it is excessive, repetitive, or manifestly unfounded. In the event that We determine that the request warrants a fee, We will tell you why We made that decision and provide you with a cost estimate before completing your request.

• Disclosure to owners, landlords, management companies, and other entities in the course of our provision of services to such parties;
• Auditing purposes;
• Detecting security incidents and protecting against malicious, deceptive, fraudulent, or illegal activity;

• Short-term uses;

We have collected certain categories of Personal Information in the preceding twelve months since this notice was last updated from a variety of sources including you, your use of our services, your devices, our affiliates, our vendors, and our service providers.

• Owners, landlords, management companies, and other entities involved in our provision of services to such parties.
• Affiliates.
• Vendors and service providers, including for data analytics and marketing and advertising our products and services to you.
• Third parties integrated into our services.
